Caregiver activity

Triggering events The date of receipt of the request for early release, allowing the saver or their spouse / civil partner (PACS) to assist a person:
- with a disability
- experiencing loss of autonomy
- receiving an additional allowance for third-party assistance (MTP)
Main conditions The saver is considered to be acting as a caregiver when providing assistance to one of the following individuals (as defined in Articles L. 3142-16 and L. 3142-17 of the French Labour Code):
- their spouse, partner, or civil partner (PACS)
- an ascendant, descendant, or dependent child as defined in Article L. 512-1 of the French Social Security Code
- a relative up to the 4th degree (such as a brother, sister, aunt, uncle, nephew, niece, etc.)
- an ascendant, descendant, or relative up to the 4th degree of their spouse, partner, or civil partner (PACS)
- an elderly or disabled person with whom they reside or with whom they have close and stable ties, and to whom they provide regular and frequent non-professional assistance with some or all daily living activities

The person receiving assistance must reside in France on a stable and regular basis
Rights related to fund release Rights accrued prior to the triggering event:
- Profit-sharing, incentive bonuses (and any matching contributions) allocated to the saver and relating to financial years closed as of the date of the triggering event.
- For other contributions (and any matching contributions), only the assets recorded in the account as of the date of the triggering event are eligible for early release.
Supporting documents, depending on your situation

When the person being assisted is a relative of the applicant:
Family record book or a sworn statement attesting to the family relationship between the applicant and the person being assisted And a sworn statement confirming the assistance provided

When the person being assisted is not a relative of the applicant:

Sworn statement attesting to close and stable ties with the elderly or disabled person with whom the applicant resides or maintains close and stable relations And a sworn statement confirming the assistance provided And, depending on the situation of the person being assisted:

If the person being assisted is a disabled child dependent on the applicant, as defined in Article L. 512-1 of the Social Security Code

(i.e., living in the household and under 15 years old as of 30 April of the current year, or a disabled child living in the household regardless of age, or a disabled adult):
- A copy of the decision issued under social security or social assistance legislation, confirming a permanent disability rate of at least 80%

If the person being assisted is experiencing a loss of autonomy:
- A copy of the decision granting the personalized autonomy allowance (APA) as referenced in Article L. 232-2 of the Social Action and Family Code

In all cases, if the person being assisted receives any of the following allowances or benefits:
- A copy of the decision granting one of the following (as applicable):
- Third-party assistance supplement (MTP) for constant help
- Or Additional benefit for third-party assistance
- Or Special supplement for third-party assistance from the National Pension Fund for Local Government Employees (CNRACL)
- Or Supplement granted to civil servants and magistrates with disabilities who require third-party assistance for daily living activities
- Or Third-party assistance supplement for military personnel and war victims
- Or A certificate from the employer of the beneficiary, or the employer of their spouse or civil partner, stating that they are on caregiver leave

Or if the person being assisted does not receive any of the above-mentioned benefits and the account holder, spouse, or civil partner is not on caregiver leave, only a copy of the allocation decision needs to be provided
